Website Services Terms and Conditions
The website package offered is intended for personal or small business websites. Small business is defined as a company or organization that has approximately 50 employees or less.
Payments are accepted via credit or debit card only. Checks are not accepted. All fees/payments are non-refundable. If a payment is unsuccessful or not received by the due date, you will be notified via e-mail and will have five (5) business days to correct the issue. If your account is not brought current in that time, your account will be suspended and subject to the terms in the Cancellation section below.
Prices reflect a minimum one year commitment. After the first year, the standard annual or monthly renewal rate for maintenance and edits will apply. Billing will continue monthly or yearly until the account is cancelled. See “Account Cancellation/Closing” below for more information.
You may cancel or close your account at any time. If the cancellation occurs within the first year, any remaining balance will immediately become due and payable. There will be no partial refunds. Upon cancellation and settlement of your account, you will be sent a copy of all files used to create your site, as well as instructions for transferring your domain to your preferred registrar. Assistance will be provided with choosing a new web host, if requested. Moving the site to a new host will be your responsibility; if you prefer we can move it and all settings for you for a nominal fee.
Optional services are any services which are outside the scope of these Terms and Conditions. These include, but are not limited to any on-site work and custom photography. Such services will be charged at standard hourly rates, which will be stated in any agreement you may enter into.
Prices do not include Flash authoring. Client-supplied, pre-designed Flash objects are allowed at no extra charge.
We will not allow some types of websites. These include (but are not limited to):
- Sites that are adult or pornographic in nature
- Sites that facilitate, condone, or encourage copyright infringement
- Sites that are set up primarily for file/photo/media sharing, distribution or storage
- Sites that promote hate speech
- Sites that require daily updates by Divergex staff
- Sites that require large numbers of membership accounts (excluding e-commerce)
- Sites that directly send large volumes of electronic mail
- Sites that require more than 2GB of storage space or unusually high bandwidth
Divergex reserves the right to refuse service to anyone for any reason.
