Website Services Terms and Conditions

Payments

Payments are accepted via credit or debit card. Checks are accepted, but require a five (5) business day clearing period. All fees/payments are non-refundable. Returned checks are subject to a $35 fee and refusal of future check payments.

Additional Fees/Optional Services

Unless otherwise agreed, all sites are built on the WordPress platform. Certain functionality that you request may be available via third-party plugins at an additional cost. Fees for such plugins and other third-party features are your responsibility and are non-refundable.

“Optional Services” is defined any service which is outside the scope of these Terms and Conditions. These include, but are not limited to on-site work and custom photography and/or video. Such services will be charged at an hourly rate of $60 per hour.

Pricing

All negotiated website design prices are for design and uploading only. You are responsible for maintaining your domain registration and hosting, unless otherwise negotiated.

Account Cancellation/Closing

If you are utilizing services billed on a monthly basis, you may cancel or close your account at any time.  There will be no partial refunds.

Miscellaneous

Prices do not include Flash authoring. Client-supplied, pre-designed Flash objects are allowed at no extra charge.

Your site may be used in our marketing and promotional materials.

We do not allow some types of websites. These include (but are not limited to):

• Sites that are adult or pornographic in nature
• Sites that facilitate, condone, or encourage copyright infringement
• Sites that are set up primarily for file/photo/media sharing, distribution or storage
• Sites that promote hate speech
• Sites that require daily updates by Divergex staff
• Sites that require large numbers of membership accounts (excluding e-commerce)
• Sites that directly send large volumes of electronic mail
• Sites that require more than 2GB of storage space or unusually high bandwidth

Divergex reserves the right to refuse service to anyone for any reason.
